James Fishback<\/strong> owes his former hedge fund employer, Greenlight Capital<\/strong>, more than $1.3 million, a federal Judge has ruled.<\/p>\n

U.S. District Judge Paul Engelmayer<\/strong> has entered a final judgment ordering the Florida gubernatorial candidate to pay Greenlight Capital and its affiliate, DME Capital Management, more than $1.31 million in attorneys fees and costs, closing out a long-running fee dispute stemming from Fishback’s contentious split from the hedge fund.<\/p>\n

The figure does not include post-judgment interest, which Greenlight is separately entitled to collect.<\/p>\n

The judgment<\/strong>, filed Tuesday in the U.S. District Court for the Southern District of New York, includes $1,198,464.02 in fees and $120,052.01 in costs. It formalizes a June 23 order<\/strong> in which Engelmayer sided largely with Greenlight after the firm sought roughly $1.9 million and Fishback’s attorneys argued the request was excessive.<\/p>\n

Engelmayer trimmed the total, but said Fishback’s conduct in dragging out the litigation<\/strong>, in part, justified the bulk of the award. He called Fishback\u2019s claim that he would have settled earlier \u201clegally and factually meritless,\u201d adding that while the case was \u201crelatively complex,\u201d it \u201cdid not present novel or cutting-edge issues.\u201d<\/p>\n

The ruling is the latest financial blow in Greenlight’s yearslong legal fight<\/strong> with Fishback, a former research analyst for the company. Greenlight sued him after his 2023 departure, accusing him of misrepresenting his role at the firm \u2014 he claimed the title \u201chead of macro,\u201d which Greenlight says never existed \u2014 while secretly building his own investment firm, Azoria Capital<\/strong>, using confidential Greenlight portfolio information.<\/p>\n

Fishback has since admitted to sharing that data.<\/p>\n

The new judgment adds to a mounting pile of legal debt. A federal Magistrate Judge in January ordered Fishback to turn over<\/strong> Azoria stock certificates and dozens of personal luxury purchases to the U.S. Marshals Service to satisfy a separate $229,000 judgment, which Fishback has said he won’t pay.<\/p>\n

Azoria trustees voted to liquidate<\/strong> the company\u2019s only two exchange-traded funds in December, just months after launching, after the products attracted limited investor assets before shutting down.<\/p>\n

He also lost an arbitration bid<\/strong> against Greenlight last Spring after failing to participate in the case. And his former law firm, Abrams Fensterman<\/strong>, moved to withdraw from representing him<\/strong> over more than $150,000 in unpaid bills.<\/p>\n

The fee ruling comes as Fishback presses forward with a campaign for Governor in the Aug. 18 Republican Primary, where he trails front-runner U.S. Rep. Byron Donalds<\/strong> badly in both polling and fundraising. Lt. Gov. Jay Collins<\/strong> and former House Speaker Paul Renner<\/strong> are also in the crowded race.<\/p>\n

Fishback notched a rare legal win last month, when Leon County Judge David Frank <\/strong>sided with him in a lawsuit Collins brought<\/strong> to boot him from the race on residency grounds. Collins argued Fishback failed to meet Florida’s seven-year residency requirement for Governor, pointing to a 2020 vote Fishback cast in Washington, D.C., and a homestead exemption he later claimed on a D.C. condo.<\/p>\n

Fishback admitted during an eight-hour hearing that he had indeed voted in D.C. in 2020 and held the homestead exemption<\/strong> \u2014 reversing months of denials \u2014 but Frank found his sworn testimony that he never intended to abandon Florida residency legally sufficient, since Collins’ side offered no witness to directly contradict it.<\/p>\n

Frank noted that the D.C. paperwork could still expose Fishback to separate legal consequences.<\/p>\n

Collins has not ruled out an appeal. The\u00a0voting violation<\/strong>\u00a0carries penalties of up to five years in prison and $10,000 in fines, while the\u00a0homestead infraction<\/strong>\u00a0confers maximum penalties of 180 days in jail and $1,000 in fines alongside repayment, interest and tax penalties.<\/p>\n

Fishback has additional legal issues. A former debate champion who says Fishback\u2019s nonprofit, Incubate Debate, still owes her $8,000 in promised scholarship money, filed a small claims suit<\/strong> in Broward County last week.<\/p>\n

Significantly underfunded, compared to others in the race, Fishback has repeatedly made headlines while running for Governor by employing racist, antisemitic and xenophobic verbiage in his campaign messaging.<\/p>\n

A frequent target has been Donalds, a Black man whom he\u2019s called a \u201cslave<\/strong>\u201d to his donors and corporate interests, a \u201cDEI Republican\u201d and \u201cBy\u2019rone.\u201d After last week\u2019s hearing, Fishback\u00a0again invoked Donalds\u2019 race<\/strong>\u00a0while announcing a proposal, named for Donalds, to eliminate Florida\u2019s three-day waiting period on firearm purchases.<\/p>\n

Fishback has also appeared on a podcast alongside\u00a0self-described admirers<\/strong>\u00a0of\u00a0Adolf Hitler<\/strong>\u00a0and has rubbed elbows with other members of the so-called \u201cmanosphere\u201d who traffic in misogynistic, antisemitic and racist rhetoric.<\/p>\n

Court filings also revealed Fishback, aided by campaign Treasurer James Munguia<\/strong>\u00a0\u2014 one of two witnesses to testify in his defense last week, along with Fishback\u2019s father \u2014\u00a0directed the use<\/strong>\u00a0of fake social media accounts to plant tips and inflate his media coverage.<\/p>\n

Eleven Republicans qualified for Governor this cycle, but the race isn\u2019t close, according to recent polling from the\u00a0Tyson Group<\/strong>. The survey showed Donalds at 48% support, with Collins at 9%, Fishback at 8% and former House Speaker\u00a0Paul Renner<\/strong>\u00a0at 4%.<\/p>\n

The latest polling from FiftyPlusOne<\/strong> has Donalds polling at 50%, compared to 16% for Collins, 12% for Fishback and 4% for Renner. Other surveys last month found Donalds with between 32% and 50% of the GOP vote, with Fishback holding no more than a 13% share.<\/p>\n

On the Democratic side, former U.S. Rep.\u00a0David Jolly<\/strong>\u00a0is widely considered the likely nominee.<\/p>\n

The Primary is Aug. 18, followed by the General Election on Nov. 3.<\/p>\n
